The Labour Court accepted McCormick Macnaughton Limited’s claim that it could not pay the final 2.5% phase of the Towards 2016 agreement, due from 1 April 2008. The recommendation was signed on 9 February 2009. The dispute concerned 90 workers represented by Unite & Agemou at the company’s Naas Road premises. The company cited a €150,000 retrospective cost and a forecast €11 million loss for 2008. The Court said it faced serious financial and competitive pressures and could not pay the increase.
