The Labour Court recommended that Hochtief Facility Management pay €20,000 to a worker it found had been unfairly selected for redundancy. The recommendation was signed on 13 November 2008.
The Technical, Engineering and Electrical Union said the worker was made redundant and replaced by someone on a substantially lower salary after she complained about a senior manager. Hochtief said financial losses required cost cuts, her section was restructured and she had declined alternative work.
The Court noted the company’s economic difficulties but found that ending the worker’s employment in the circumstances amounted to unfair selection for redundancy. It recommended €20,000 in full and final settlement.
