The Labour Court recommended that HSE West consult the Psychiatric Nurses Association about any industrial relations implications for members of transferring long-term patients to hostel accommodation run by Rehab Care. The recommendation was signed on 3 November 2008. The union said it had not been consulted before the changes were announced. HSE West said patients had requested discharge and relocation nearer their geographical, cultural and family origins, and that the transfers were based on medical grounds. The Court said employers had a clear obligation under Towards 2016 to consult unions in advance of and during such exercises, while saying it would not involve itself in clinical matters.
