The Labour Court recommended that Cork University Hospital pay a manager in its Social Work Department €9,985.44 in salary retrospection dating back to 1 January 2000. The recommendation was signed on 29 September 2008.
The manager sought the full benefit of Circular 145/2000, which provided for a salary differential for certain roles in the former Eastern Regional Health Authority. The HSE argued that the circular did not apply outside that area and that the manager had accepted its personal extension from 1 January 2004 in full settlement.
The Court said there was no evidence that she had accepted the personal extension as full and final settlement. Taking account of assurances given to her, it recommended that the hospital fulfil its commitment and pay the retrospection.
