The Labour Court did not recommend conceding the Services Industrial Professional Technical Union’s claim for overtime for Dawn Dairies’ van sales drivers. The recommendation was signed on 12 August 2008. The union said a written agreement set out overtime arrangements and drivers worked extended hours. Dawn Dairies said the work could be completed within 39 hours and drivers controlled the length and timing of their rounds. The Court found drivers had no fixed hours and their working time depended on the demands of the job, so overtime payments did not apply.
