The Labour Court recommended that Conoco Phillips Whitegate Refinery Limited and the Technical, Engineering And Electrical Union renegotiate their 1986 agreement on filling supervisory posts, and accept the appointments already made. The union argued the appointments breached the agreement and sought a permanent promotion for a worker. The company said the disputed role was not covered and it had selected the most suitable candidates. The Court said the agreement could not readily be adapted to the company’s substantially changed circumstances. Its recommendation was dated 20 June 2008.
