The Labour Court recommended that Four Star Pizza pay a worker €1,300 in full settlement of claims for unpaid wages and holiday pay. The recommendation was signed on 20 June 2008. The worker, employed as a delivery driver from November 2007 to around January 2008, said he was paid €5 an hour plus €1 per delivery in cash and received no payslips. He sought arrears of pay and holiday pay. Four Star Pizza did not attend the hearing but sent the Court a written statement disputing the worker’s employment dates and status. The Court accepted the worker’s uncontradicted evidence that he was owed pay and holiday pay, had not received written terms and conditions, and was employed under a contract of service. The recommendation was without prejudice to any claims under employment rights legislation.
