The Labour Court did not recommend concession of a union claim over Bus Eireann’s handling of a Tyre Fitter/Engineering Operative vacancy at Stranorlar Garage. The recommendation was signed on 30 May 2008. The unnamed Engineering Operative was represented by the Services Industrial Professional Technical Union. The union argued the company had decided the worker was unfit before advertising externally. Bus Eireann said the Stranorlar role involved heavier work than his Letterkenny position and cited the Chief Medical Officer’s assessment. The Court found the company had to comply with its duty of care and could not consider him suitable for the post; it accepted the Joint Industrial Relations Forum’s conclusions.
