Labour Court recommends no change to former worker’s pension position

The Labour Court recommended no change to the existing pension position in a claim by a former worker against Magna Donnelly Electronics Naas Ltd. The recommendation was signed on 21 May 2008. The worker said the amount offered from the fund when the company closed was lower than expected and sought recompense. The company said responsibility for the defined-benefit scheme rested with its trustees. The company had contributed 10% annually into the fund on the worker’s behalf during six years of employment. The Court accepted assurances that the fund met minimum standards and that the trustees had discharged their responsibilities, and said it could not accept the worker’s complaint as reasonable.
