The Labour Court supported Ryan Brothers (Quarry) Limited’s interpretation of a holiday-pay clause in its dispute with the Services Industrial Professional Technical Union. The recommendation was signed on 21 May 2008. The union argued that the 2005 agreement entitled employees to an additional half of their average weekly overtime earnings for each day of annual leave. The company said that reading would mean paying 2.5 times average overtime earnings for each leave day. The Court found the union’s interpretation would produce an absurd result and was not supported by the agreement’s wording.
