Labour Court recommends pension-scheme consideration for Frymount worker

The Labour Court recommended that Frymount Limited consider a worker for entry to its pension scheme under the normal rules. If admitted, she should receive the scheme’s enhanced sick-pay terms retrospectively from 8 November 2006. The recommendation was signed on 13 May 2008. The Court found the company had correctly applied the non-pension-member terms through 7 November 2006, but that pension-member terms should have applied from 8 November, when the worker became eligible to join. The worker had claimed repeated sick-pay benefits for later holiday years; the company said it had paid what the scheme allowed.
