The Labour Court recommended that Henry Denny & Sons pay four weeks’ pay per year of service plus statutory entitlements without a cap, along with the notional payment. It also recommended that the 40% deduction from the formula not apply. The recommendation was dated 28 March 2008. The dispute concerned compulsory redundancies following the end of bacon processing at the company’s Tralee plant. The Services Industrial Professional Technical Union sought to remove the deduction from the enhanced redundancy formula. The company said its existing severance terms compared favourably with those elsewhere and further enhancements would have serious cost implications.
