In 2008, the Labour Court recommended that HSE West Mayo General Hospital, the Services Industrial Professional Technical Union and the Irish Nurses Organisation agree new rosters for Clinical Nurse Manager I staff. The recommendation was signed on 7 January 2008. The unions sought to upgrade 12 to 15 CNM Is to CNM II grade, arguing that they did the same work. HSE said the nursing structure followed the Commission on Nursing report and warned that upgrading could lead to further claims. The Court found that CNM Is rostered opposite CNM IIs were essentially carrying out the same role, with no clear distinction between the grades’ duties. It recommended new rosters to address the overlap and a lump sum equivalent to the acting-up allowance, dating from the union’s claim.
