Labour Court recommends statutory redundancy for worker after move to Finglas

By Orla Quinn

Labour Court ·

The Labour Court recommended statutory redundancy for a worker after Data Conversion (Software) Limited, trading as Data Conversion, moved its operations to Finglas. The recommendation was signed on 22 November 2007. The worker, represented by UMTTIE, said she should have been invited to a staff meeting about the move and offered the same severance package as colleagues. The company said it did not know she remained on its books after a long absence and that her employment had ended on capability grounds. The Court noted uncertainty about her employment status and statutory entitlement. It resolved those doubts in her favour, taking account of her length of service, and recommended statutory redundancy based on her service up to the move.
