The Labour Court did not recommend conceding the Psychiatric Nurses Association’s claim for additional premium pay for 20 extra minutes on Unit 5B night shifts at HSE Mid Western Area. The recommendation was signed on 13 November 2007. The nurses worked shifts of 11 hours and 45 minutes but were paid for 11 hours and 25 minutes. The union said leave in lieu did not reflect the night-work premium and sought time-and-a-quarter pay, or double time on Sundays and bank holidays. HSE Mid Western Area said the arrangements followed local procedures agreed with nursing staff and compensated them for the time worked. The Court considered the employer’s interpretation of the compensation arrangement correct.
