The Labour Court recommended against HSE North West seeking to recover disputed premium-pay overpayments from nursing staff, finding in favour of the Irish Nurses Organisation. The recommendation was signed on 5 November 2007. The dispute followed a change in how night-duty premiums were calculated during the introduction of a new payroll system. The Court said the method caused both underpayments and overpayments over 15 months. The HSE repaid the underpayments and sought to recover the overpayments, but the Court said the circumstances did not support recoupment.
