The Labour Court did not recommend that the National Disability Authority concede a union claim for a worker’s early retirement, finding the worker’s office had not been abolished. The recommendation was signed on 8 November 2007. The worker had transferred to the Authority after the National Rehabilitation Board was dissolved in 2001 and was seconded to the National Educational Psychological Service. The union argued the office had been abolished and the law allowed additional pensionable service. The Authority said the office had transferred and the worker did not qualify. The Court recommended that the parties explore, without commitment, whether the worker could leave the Authority on agreed terms.
