Labour Court recommends Dublin Port Company concede five workers’ lost-pay claim

The Labour Court recommended that Dublin Port Company concede the five marine port operatives’ claim for pay lost during suspension, in return for their full participation in the training obligations set out in the 2003 agreement with the Technical, Engineering and Electrical Union. The recommendation was signed on 2 October 2007. The union said the training request breached the agreement and raised health and safety concerns; the company said it needed flexibility to meet business needs. The Court said workers were committed to training and familiarisation, but the agreed grievance procedure had not been followed and the action taken by one side was unjustified.
