The Labour Court did not recommend conceding C & C Group of Unions’ claim for compensation and a goodwill payment for workers affected by the sale of C & C Group plc’s non-alcohol business to Britvic. Its recommendation was signed on 13 September 2007. The union argued that transferring workers would lose access to profit-sharing and save-as-you-earn schemes and sought compensation. The Court found the schemes were not established employment conditions that could support compensation if discontinued, and said a goodwill payment was unjustified. If a profit-share payment for the current year were made, however, the Court recommended that workers associated with the claim receive a share of accrued entitlements based on their service up to the sale date.
