The Labour Court recommended that former Microtherm Ltd (in Liquidation) workers receive an ex-gratia payment of four weeks’ pay per year of service, plus their statutory entitlements. The recommendation was signed on 9 July 2007. The Services Industrial Professional Technical Union and the Technical, Engineering and Electrical Union sought six weeks’ pay per year of service, based on P60 earnings without a cap. Microtherm said it could not fund enhanced payments while being wound up. The Court said fairness and equity called for reasonable compensation and urged the company’s shareholders to make funds available.
