The Labour Court recommended €5,000 compensation for a worker dismissed by GMC Civil & Mechanical Engineering Limited after a crane on his lorry struck a bridge. The recommendation was signed on 27 June 2007.
The company said the incident involved gross negligence and misconduct. The Court agreed the incident warranted the most severe disciplinary sanctions, but said the company’s lack of procedures and disregard for the worker’s basic rights made the method of dismissal procedurally unfair.
