The Labour Court recommended that Health Services Executive - West restore staffing at pre-embargo levels without agency workers, using normal competition and allowing agency workers to apply. The recommendation was signed on 11 June 2007. The Irish Municipal, Public and Civil Trade Union said agency hiring without its agreement breached national agreements and sought direct employment for the workers. Management said agency staff were an interim response to a recruitment embargo and reduced staffing ceilings. The Court found the lack of prior consultation breached the agreements.
