The Labour Court found genuine redundancies arose after work ended in the Clare and Limerick region, and said Brian Mc Carthy Contractors Ltd did not have to place the workers on lay-off. The recommendation was signed on 6 June 2007. The Building and Allied Trades Union had argued the workers could have been laid off or transferred to other company sites. The Court said the company’s assurance to contact former bricklayers first when suitable work became available in Limerick was reasonable and should be accepted. It recommended that the union pursue wider lay-off and recall questions through the National Joint Industrial Council for the Construction Industry.
