The Labour Court recommended that Dublin Airport Authority PLC pay a worker the salary she would have earned through the end of her fixed-term contract, in full and final settlement of her unfair dismissal claim. The recommendation was signed on 8 March 2007.
The Court found material deficiencies in the dismissal procedure. It said the employer had not made clear early enough that the worker’s continued employment was at risk, and found an element of unfairness in moving to dismissal after an August 2006 incident. The recommendation does not specify a euro amount.
The worker said the performance allegations against her were not substantiated and alleged harassment and bullying by senior staff. The employer said it had given adequate warnings and opportunities to improve, and had lost trust and confidence in her. The parties had agreed to be bound by the recommendation.
