The Labour Court recommended that Poolbeg Yacht & Boat Club treat a worker’s position as redundant and, in addition to statutory redundancy pay, pay her a sum equivalent to the applicable rebate. The recommendation was signed on 21 February 2007. The worker sought the restoration of her former 11 weekly hours and compensation after her hours were reduced to four. The club cited poor trading and said it could not restore the hours. The Court accepted that restoration was not possible and recommended the redundancy terms.
