Labour Court recommends €500 payment by Tesco Ireland to reassigned worker

The Labour Court recommended that Tesco Ireland pay a worker €500 after finding the company bore some responsibility for his reassignment. The recommendation was signed on 15 February 2007. The worker, assigned to Tesco Ireland by Grafton Recruitment, said he was dismissed after protesting about his pay and picking rates and taking part in trade union activity. Tesco argued that Grafton Recruitment employed him and controlled his assignment. The Court did not recommend conceding the dismissal claim, finding that the worker’s inability to accept alternative employment did not constitute dismissal. It recommended the €500 payment because Tesco had requested his removal and bore at least some responsibility for his reassignment.
