The Labour Court recommended that Dublin City Council offer a craft gardener a €5,000 ex-gratia lump sum in full and final settlement of claims over acting-up duties and a car allowance. The recommendation was signed on 31 October 2006. The Services Industrial Professional Technical Union said the worker had carried additional senior duties at Markiewicz Park, Ballyfermot and sought an Acting Foreman rate and an additional €800 car allowance. The Council disputed that he managed two areas and said he had received the appropriate travel allowance; it had proposed €1,800 ex gratia. The Court was not satisfied that an acting-up allowance was due, but found that the worker had performed some work above his grade’s requirements over an extended period.
