The Labour Court recommended that Bus Eireann appoint the most senior person proposed by management to a vacant driver board at Rosslare Harbour without further delay. Its recommendation, dated 25 October 2006, did not recommend conceding the National Bus & Rail Union’s claim. The NBRU said the way applications were handled breached normal procedures, while seniority itself was not disputed. Bus Eireann said a communications problem had led to an initial incorrect appointment and that the appointment followed custom and practice. Services Industrial Professional Technical Union also sought the post for its more senior member.
