The Labour Court recommended that McGrath Industrial Waste set a rate for all drivers based on £230.75 in January 1998 terms, adjusted for intervening national pay agreement phases. The increases were to be retrospective to January 2005. The union, Services Industrial Professional Technical Union, said a 1997 agreement linked drivers’ pay to Mayo County Council refuse collection drivers and sought restoration of the link and backdated increases. McGrath Industrial Waste denied an ongoing parity agreement. The Court found an agreement had fixed a rate for the job but found no evidence of continuing pay parity. Its recommendation was signed on 23 October 2006.
