The Labour Court recommended that Tyco Electronics Limited buy out workers’ disputed entitlement to enhanced holiday pay with a payment equal to twice the amount claimed annually, subject to a minimum of €350 for each qualifying employee. The recommendation was dated 12 June 2006. Services Industrial Professional Technical Union argued that six extra annual leave days, given instead of a 39-hour week, should include the earnings-related holiday bonus. Tyco said the days were not contracted and should not be included in the calculation. The Court said an industrial relations solution was needed. It did not recommend concession of the union’s claim, but recommended the buy-out payment instead.
