The Labour Court recommended that Kildare Chilling Company pay the Sustaining Progress increases in full from their due dates, after rejecting the company's inability-to-pay case. The recommendation was dated 15 May 2006. Services Industrial Professional Technical Union had sought payment without first agreeing to cost-offsetting measures. The company said the increase would cost €450,000 and proposed measures it said could save €55,000. The Court noted that the company had not supplied audited accounts to support its inability-to-pay claim. It recommended negotiations on changes sought by the employer after the increases were paid.
