The Labour Court found that a former general manager was unfairly dismissed by Portmarnock Sports And Leisure Club and recommended €5,000 compensation. In a recommendation dated 9 February 2006, it found the club had decided to dismiss him before giving him an opportunity to answer allegations. The club said performance problems and alleged misconduct justified the dismissal. The Court also found that the worker’s underperformance contributed to his dismissal and said this should be taken into account in compensation.
