The Labour Court recommended that Iss Ireland apply the overtime premia in the Contract Cleaning Employment Regulation Order to the Joint Labour Committee hourly rate as a minimum, and pay applicable retrospection from 1 January 2005. The recommendation was signed on 15 November 2005. The Services Industrial Professional Technical Union argued that night-shift workers should receive overtime premia as well as their shift premium. Iss Ireland said the workers' composite rate already covered overtime and that its approach complied with the order. The Court interpreted the order as requiring the specified overtime premia to be calculated on at least the JLC rate, which was €8.25 an hour from 2 September 2005.
