The Labour Court recommended that the National Disability Authority, the National Educational Psychological Service and the Department of Education and Science meet the Irish Municipal, Public and Civil Trade Union to establish which body was a worker’s employer. The recommendation was dated 3 October 2005. The worker, a former principal psychologist, sought to retire under section 66 of the Local Government (Superannuation) Consolidation Act, 1998, after his post at the National Rehabilitation Board was abolished and he transferred to the National Disability Authority. The Court said the body identified as his employer should then address the union’s claim. If the matter was not resolved within a month, it could be referred back to the Court.
