The Labour Court recommended no change to Fas’s decision not to promote a Grade 5 manager to director, and said any reorganisation of his duties should be carried out with tact and sensitivity. The recommendation was dated 4 October 2005. The Services Industrial Professional Technical Union challenged the promotion competition and the reassignment of duties. The Court found no basis to alter the competition result: an acknowledged interview-score error was replicated for other candidates and did not materially affect the worker’s ranking. It said allocating duties was primarily a management prerogative, while urging Fas to recognise the worker’s contribution during any reorganisation.
