The Labour Court recommended that P.J. Carroll & Co. make an ex-gratia payment of €650 to a retired van driver to settle a dispute over whether he should receive a share of an earlier settlement. The recommendation, dated 22 August 2005, followed a claim brought by the worker, represented by the Services Industrial Professional Technical Union. The Court could not establish the historical facts and said those it established did not appear to support the worker’s case on the balance of probabilities. It said no benefits should flow to him from the earlier recommendation, but proposed the payment to dispose of the matter in this unique situation.
