The Labour Court recommended that Mbna Ireland apologise to a worker, remove written records relating to her health from its files and give them to her, and donate €5,000 to a charity she nominates. The recommendation, dated 23 August 2005, followed the worker’s claim that she resigned after rumours about her health circulated at work. The Court found a minute about the worker inaccurate and said MBNA acted unreasonably by refusing to remove it. It did not find constructive dismissal, saying she could have pursued the matter further before resigning, but concluded that the company had acted unfairly toward her.
