The Labour Court found that Sam Hire Limited unfairly dismissed a worker and recommended compensation equal to six months' pay in full and final settlement. The worker, represented by the Services Industrial Professional Technical Union, had been employed to deliver and collect hired tools and machinery. The Court found that the worker's probation had been completed and could not be extended retrospectively. It also found that Sam Hire denied the worker fair representation when pursuing a grievance. The recommendation was signed on 22 July 2005.
