The Labour Court recommended that the Health Service Executive-Western Area and the Services Industrial Professional Technical Union agree arrangements to accommodate seven staff at Barr Aille residential care unit on day work. The recommendation followed a dispute over a proposed night roster and was dated 30 June 2005.
The Court found the staff had a well-established pattern of day work and a legitimate expectation that it would continue. It said arrangements could be reviewed if practical or operational difficulties arose, and that the recommendation reflected exceptional circumstances.
