The Labour Court recommended compensation after finding that a worker employed by Brendan O'Rourke/Nydal Limited was paid the National Minimum Wage and had deductions for lodging, rather than the accepted construction industry general workers' rate. The worker, one of four Polish workers, was paid €7 an hour. Services Industrial Professional Technical Union (SIPTU) said he should have received the registered agreement rate of €12.77 an hour and claimed €11,859 in unpaid wages. The company said it would pay the appropriate rate and retrospective pay if he provided evidence that he was a tradesman. In a recommendation dated 28 June 2005, the Court proposed €4,000 compensation for David Plaska, the longest remaining worker, and €3,000 for each of the other three workers.
