The Labour Court recommended that Navan Building Services pay a worker compensation equal to two weeks’ wages after finding his dismissal procedurally unfair. The recommendation was dated 27 May 2005. The Services Industrial Professional Technical Union said the worker was dismissed after refusing to drive a lorry he considered unsafe. The company said he had received warnings and left after refusing instructions. The Court found that the worker had not been given an adequate chance to present a defence before dismissal, but also found that he had provided unsatisfactory service and contributed to the circumstances leading to his dismissal. The recommended compensation was in addition to what he had already received.
