The Labour Court found that a statutory condition for investigating the dispute had not been met because MCM Security engaged in collective bargaining for the workers concerned. It declined to investigate the substantive issues and so recommended. The recommendation was signed on 26 May 2005. The Independent Workers Union had raised security drivers’ complaints about public holiday benefits, premiums, overtime and sick pay. MCM Security said it had collective bargaining arrangements with SIPTU, which held sole negotiating rights.
