The Labour Court recommended that Dunnes Stores pay €2,000 compensation to a worker it found had been unfairly dismissed, and provide him with a suitable reference. The recommendation was dated 26 April 2005. The worker was employed at Dunnes Stores’ Mullingar premises from April 2004. After an incident at the tills on 23 August 2004, he received two weeks’ notice and was later told his dismissal was due to his work performance. Represented by Mandate, he argued he had not been warned and that a failed training exercise should have led to further training. Dunnes Stores did not attend the hearing. Based on the union’s uncontradicted submissions, the Court found the worker had completed probation and received no performance warning before the dismissal decision.
