The Labour Court recommended hourly rates from €16.76 to €17.80 for craft workers and €15.13 for non-craft workers at Johnson Controls' IBM site in Mulhuddart, depending on craft workers' post-apprenticeship experience. The recommendation also set a 33.33% premium for four-cycle shifts, but did not support including shift pay in overtime calculations. The Technical, Engineering And Electrical Union had sought higher rates, a larger shift premium and shift pay included in overtime. It said the company's overtime calculation divided consolidated shift pay by 130% and multiplied by 100% to derive a notional hourly rate. Johnson Controls rejected the claims, arguing it was not an electrical contractor and paid overtime on basic pay under workers' contracts. The Court recommended the rates as part of a sectoral approach to facilities-maintenance pay. The recommendation was signed on 19 April 2005.
