The Labour Court recommended that NUVOTEM and the Services Industrial Professional Technical Union review a claim for the final phase of the Programme for Prosperity and Fairness after the next national minimum-wage adjustment. The recommendation was dated 21 March 2005. The union sought payment of the increase, backdated to 1 April 2002, for six full-time staff. NUVOTEM, represented by Irish Business and Employers' Confederation, said trading difficulties left it unable to pay. The Court said the information before it showed a clear inability to pay and noted that the union did not dispute the information's accuracy.
