Labour Court says Bruss dismissal should stand but recommends pay for absence

The Labour Court recommended that Bruss leave a worker’s dismissal in place after finding it was not unfair during probation. It also recommended paying him for his second absence and providing a reference. The worker, represented by the Services Industrial Professional Technical Union, had challenged his dismissal at the end of a 16-week probationary period. Bruss said safe and competent work was essential and that the worker had received induction and safety training. The recommendation was signed on 15 March 2005. The Court also found Bruss’s record-keeping deficient and recommended that it review and tighten its probation procedures.
