The Labour Court recommended that GAMA Construction Ireland Ltd establish the outstanding wages owed to three workers and ensure payment of the agreed amount. The recommendation was dated 20 January 2005. The Building And Allied Trades Union said the workers had moved from PAYE employment to subcontracting and sought direct employment and unpaid wages. GAMA said they had never been its employees and opposed employing them directly. The Court recommended referring the amount to a Rights Commissioner under the Payment of Wages Act 1991 if the parties could not agree. GAMA should accept liability if an amount awarded could not be recovered from the person held liable. The Court did not recommend the claim for direct employment.
