The Labour Court recommended that Hitech Electronics not pay increases due under the Sustaining Progress agreement at that time. Its recommendation was dated 8 February 2005, after the Court found the company could not afford the increases. The Services Industrial Professional Technical Union sought the increases from January 2003 and challenged the independent assessor’s report. Hitech Electronics said its business had declined and that paying the increases would increase operating losses and restrict its ability to compete. The Court encouraged the parties to review the position during 2005 if the company’s finances improved.
