Labour Court recommends Lufthansa Airmotive remove worker’s verbal warning

The Labour Court recommended that Lufthansa Airmotive remove a worker’s verbal warning from his personnel file after finding the disciplinary procedure appropriate. The recommendation was dated 19 January 2005. The dispute followed the worker’s workplace absences and a verbal warning issued on 26 May 2004. The Technical, Engineering And Electrical Union argued that the warning was unwarranted and that the worker, a senior shop steward, had been targeted. Lufthansa Airmotive said it could not manage unpredictable attendance after efforts to agree arrangements had failed. The Court recommended that the parties try to resolve their poor working relationship. It also recommended that the worker formally request structured time off and that management accommodate the request as far as possible. The warning should be treated as lapsed from the recommendation date and removed from his file.
