The Labour Court did not recommend concession of a general operative’s redundancy claim against Hertel (Ireland) Limited. Services Industrial Professional Technical Union said two workers with less service had been retained and argued the worker was unfairly selected. Hertel said it selected two workers from a pool of six using length of service, attendance, disciplinary record and qualifications. The Court found the method used was consistent with the parties’ agreement on merit and service, while saying they should set out clearer criteria for measuring merit. The recommendation was signed on 17 January 2005.
